NEW POINTS OF CIRCULAR 68/2019 / TT-BTC ON TIME OF E-BILLING

From November 1, 2020, enterprises, economic organizations, other organizations, business households and individuals must register for the application of e-invoices under the guidance in this Circular.
From November 1, 2020, the Circulars and Decisions of the Ministry of Finance specified in Clause 2 of this Article cease to be effective.

Time to issue electronic invoices
- For the sale of goods, it is the time of transferring the ownership or the right to use the goods to the buyer, regardless of whether the money has been collected or not.

- For service provision, it is the time when the service is completed or the invoice for service provision is made, regardless of whether the money has been collected or not.

- In case of multiple deliveries or delivery of each item or service stage, each delivery or handover must be invoiced for the volume and value of the delivered goods or services respectively.

In addition, for some other cases, the time of making an e-invoice is specified as follows:

1	Supply of electricity, water, telecommunications services, television, information technology services sold periodically.	No later than 07 days after the date of recording the electricity and water consumption index or the end date of the convention period for the provision of telecommunications, television or information technology services.
2	Construction and installation activities.	Time of acceptance and handover of the completed work, work item, construction and installation volume, regardless of whether the money has been collected or not.
3	Real estate business, infrastructure construction, house construction for sale, transfer.	Real estate business, infrastructure construction, house construction for sale, transfer.
4	In case the ownership or use right has not been assigned: Collecting money according to the project schedule or the contractual collection schedule.	Date of collection or payment agreement in contract.
5	In case the ownership or use right has been assigned.	Comply with the provisions of Clause 1, Article 4 of Circular 68/2019 / TT-BTC.
6	Purchase air transport services for export via website and the e-commerce system is established according to international practice.	No later than 05 days from the date the air transport service documents are released on the website system and e-commerce system.
